Terms & Conditions
Domestic customer terms · Version 1.0 · Effective 17 October 2026
1. About these terms
These Terms & Conditions apply to domestic gardening, grounds maintenance, lawn care, pressure washing, pond maintenance, chimney sweeping and related services provided by JR Garden Services (“we”, “us”). They apply to work agreed with domestic consumers in England and Wales. Commercial contracts may have separately agreed written terms.
The agreed quotation, description of services and booking confirmation form part of the contract. If a quotation expressly varies a term, that agreed variation applies to the extent permitted by law. Nothing in these terms reduces your statutory rights.
2. Quotations, scope and pricing
We normally quote a fixed price for an agreed scope of work or per scheduled maintenance visit. We do not promise unlimited work or a fixed number of tasks beyond the agreed scope.
Unless stated otherwise, quotations are valid for 30 days. We will identify any known separate charges for materials, specialist equipment, collection, parking or waste removal before agreement.
Additional work, unforeseen conditions or changes requested by you will be discussed and priced before extra chargeable work is undertaken. A change in garden condition or frequency may require a new price for future visits; we will not apply a revised price without agreement.
3. Bookings and recurring maintenance
We will confirm the agreed work, visit frequency and price. Appointment dates and arrival windows may change by agreement or where reasonably necessary because of weather, safety, illness or other events outside our reasonable control.
Regular maintenance is limited to the tasks specified in the quotation. Major reductions, renovation, clearance, tree work, disposal and specialist treatments are excluded unless expressly included.
Where a recurring appointment is postponed, we will discuss a suitable alternative. We do not charge for a visit we cancel or cannot provide; any prepayment for work not supplied will be dealt with fairly and in accordance with your rights.
4. Customer cancellations and missed access
Please give at least 48 hours’ notice if you wish to cancel or reschedule a booked visit. Where you provide at least 48 hours’ notice, we will not normally charge a cancellation fee.
If you cancel with less than 48 hours’ notice, we may charge only for reasonable, demonstrable net losses caused by that cancellation, capped at £25 per cancelled appointment. This is not an automatic £25 fee. We will take account of expenses saved, work we reasonably obtain in the freed slot and other steps to reduce the loss. We will explain any charge if requested.
If we attend but cannot access the agreed work area because the required access was not provided, the same reasonable-loss approach and £25 maximum apply to that missed appointment. No charge will apply where we are responsible for the failure or where charging would be unfair in the circumstances.
This section does not override any statutory cooling-off right or any other mandatory consumer protection. Emergencies and exceptional circumstances will be considered fairly.
5. Statutory cancellation rights
If you agree a contract online, by phone, at your home or otherwise away from our business premises, you may have a legal right to cancel within 14 days of the contract being made, subject to statutory exceptions. We will provide the legally required pre-contract information and cancellation instructions where applicable.
If you expressly ask us to start work within a statutory cancellation period, we may be entitled to charge a proportionate amount for services actually supplied before you cancel, but only where the legal requirements are met. If the service is fully performed, your cancellation right may end only where the required express request and acknowledgement have been obtained.
To exercise a statutory cancellation right, send us a clear statement using the contact details below. Where legally required, we will supply a model cancellation form separately. This policy does not replace that form or the required pre-contract notices.
6. Weather, safety and site conditions
We may postpone or stop work where weather, ground conditions, access, equipment conditions or site hazards make work unsafe, unsuitable or likely to cause damage. We will notify you as soon as reasonably possible and discuss rearranging the work.
Please tell us about known hazards such as buried cables, irrigation, unstable paving, hidden objects, fragile structures and restricted access. Please keep pets and people clear of active work areas.
7. Access, keys and security
If you provide a key or access code, you authorise us to use it solely to carry out agreed services. We will take reasonable care to keep access information and keys secure and return them when requested or when the arrangement ends.
Please ensure gates and working areas are accessible at the agreed time. We will not share access details except where reasonably necessary and authorised.
8. Plants, lawns, ponds and treatments
We will perform services with reasonable care and skill. Living plants, lawns and ponds respond to weather, soil, water quality, shade, pests and customer aftercare, so specific growth or water-clarity outcomes cannot be guaranteed where they depend on factors beyond our control.
We will explain material aftercare requirements where relevant. Pesticide and other treatments will only be carried out where appropriate and lawful, and in accordance with applicable product instructions and safety requirements.
Pond cleaning, pump inspection and waterfall maintenance will be limited to the agreed scope; repairs, replacement parts, electrical work and specialist investigations are excluded unless separately agreed.
9. Waste, materials and equipment
Garden waste remains at the property in an agreed location unless removal is expressly included. Any removal and disposal charges will be agreed in advance. We will comply with applicable waste-handling requirements.
Materials and specialist equipment hire will be charged as set out in the quotation. If a specified material becomes unavailable, we will seek your agreement before substituting a materially different product or increasing the price.
10. Materials collection and transportation
We are happy to source, purchase and collect gardening materials on your behalf. To cover the time involved in travelling to suppliers, sourcing and purchasing items, loading, transporting and unloading materials, a minimum collection charge of £30 applies.
Where collection takes longer than one hour, additional time is charged at £40 per hour, calculated in 30-minute increments (£20 per additional half-hour or part thereof).
The £40 hourly collection rate is a separate charge for materials collection and transportation only. It does not represent or determine our standard hourly labour rate for gardening, grounds maintenance or other services, which are priced independently according to the nature and requirements of the work.
Additional charges may apply for multiple supplier visits, bulky items or specialist transportation requirements.
All collection charges will be communicated and agreed in advance, so there are no unexpected costs. The cost of the materials themselves is separate and will be shown in your quotation.
You are welcome to supply your own materials directly to the property, in which case no collection charge applies. Where materials collection is already included in an agreed fixed-price quotation, no separate collection fee will be charged.
11. Payment and deposits
Unless your quotation states otherwise, payment is due within seven calendar days of invoice. Accepted payment methods will be stated on the invoice.
For larger projects, we may request an advance payment or deposit, with the amount and purpose explained before booking. Deposits are not automatically non-refundable; any retention will be lawful, fair and proportionate to genuine losses or costs, taking account of work performed and costs saved.
If payment remains overdue, we may give reasonable notice before suspending future non-essential bookings, without affecting your legal rights. We will not impose arbitrary late-payment penalties on domestic consumers.
12. Care, damage and complaints
We will take reasonable care of your property. Please point out any fragile or concealed items before work begins. We are responsible for loss or damage caused by our failure to use reasonable care and skill or by our negligence, subject to applicable law.
We are not responsible for pre-existing defects or damage we did not cause. Nothing excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
If you have a concern, please contact us promptly with details and, where possible, photographs. We will investigate fairly and discuss appropriate remedies. Your rights under the Consumer Rights Act 2015 and other applicable law remain unaffected.
13. Photographs and personal information
We may take site photographs for assessment, quotations, job records and resolving queries. We will seek appropriate permission before using identifiable customer properties or personal images in public marketing.
We will handle personal information in line with applicable data protection law and our separately published Privacy Policy.
14. Ending regular arrangements and changes
Either party may request to end an ongoing maintenance arrangement by giving reasonable notice. Any booked appointments remain subject to the fair cancellation terms above, and we will charge only for services supplied and any lawful agreed amounts.
We may update the terms shown on our website, but updates do not automatically change an existing contract. Material changes to agreed prices, services or terms will be discussed and agreed where required.
